German international Law of Succession for successions untill 16.08.2015

According to Sec. 25 EGBGB German law of succession (Erbrecht) is applicable, if the deceased was a German citizen. If this leads to application of foreign law of succession, the German court will nevertheless apply german law of succession, if the foreign International Private Law (internationales Privatrecht) declares the german law applicable, for example because the deceased was a German resident (so-called „renvoi“).

For immovables German international law of succession accepts, if there ar special regulations in the
foreign country where the immovables are situated declaring the local law of succession as applicable on immovables  (so-calledlex rei sitae“).

Example: If an British citizen with domicile in Germany who owned a flat in London dies, German International law of succession refered to British law, which refers to the “domicile” of the deceased (= Berlin = German Law) for movables, to the place where the property is situated (= London = English Law) for immovables.

Things changed for all successions after 16.08.2015 with the new EU regulation on succession No. 650/2012 (EU-Erbrechtsverordnung).
